If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your payment method, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

By continuing and submitting this information, you agree to our purchasing policies and grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases, such as delivery agents.

IF YOU WISH TO ORDER YOUR CHOSEN DESIGN FROM VYPHANSTUDIO.COM YOU MUST INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS BY CLICKING THE ‘I ACCEPT’ BUTTON BELOW. VYPHANSTUDIO WILL BE DEEMED TO HAVE ENTERED INTO THIS AGREEMENT WITH YOU ONCE YOU HAVE CLICKED ‘I ACCEPT’.

IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU WILL NOT HAVE ANY RIGHT TO USE ANY DESIGN AVAILABLE TO BE LICENSED ON VYPHANSTUDIO.COM

1. Ordering

Ordering item: Once you have placed your order, if you have supplied us with your email address, you will receive a confirmation email. Before receiving our confirmation email, if for any reason you want to cancel your order, please contacting us via VY.DESIGNS@OUTLOOK.COM with your reference number. .

 

2. Price
The price of the products is expressed in US DOLLAR. The prices displayed include the statutory Value Added Tax (all taxes included) in USD taking into account the VAT applicable on the day of the order. Prices are subject to the VIETNAMESE T.V.A. If the VAT rate applicable on the date of the order is changed after the order has been made, the change will be reflected in the price of items without you being notified.

Vy PHAN reserves the right to change its prices at any time, provided that the price appearing in the catalogue on the day of the order will be the only one applicable to the purchaser.

3. Delivery

ALL ITEMS ARE DIGITAL DOWNLOADS, NO PHYSICAL ITEM WILL BE SHIPPED TO YOU. 

After payment confirmation, digital designs will be delivered electronically via [download link/email]. It is your responsibility to ensure that you provide a valid email address or download link.

4. LICENSE:

DIGITAL SEAMLESS PATTERN DESIGN LICENSES:

 

4.1 Exclusive license

  • Exclusive License is ONLY for you and your brands/companies/clients. You have exclusive right to use and modify the design which is instantly removed from the site once purchased. BUT you do not have the right to resale the digital files.

  • The digital design is for end products/physical products for sale including fashion garments, shirts, t-shirts, homeware, stationery, accessories, posters, postcards and commercial merchandise with no limit on the production run. The supplied downloadable file is a hi-resolution editable layered Photoshop PSD or Illustrator Vector AI / EPS file, and a photo of where the design comes from (usually from my travel and the nature). PLEASE MAKE SURE YOU HAVE THE CORRECT SOFTWARE FOR THE FILE FORMATS LISTED.

  • The resale of our DIGITAL FILES in any way IS NOT ALLOWED.

  • You can NOT claim ownership of the design, use it in a manner that infringes on our rights, or use it to create derivative works for digital resale or redistribution without prior written consent.

  • You can NOT modify, reproduce, distribute, or resell the DESIGN in ANY digital format (SVG, PNG, JPG, Ai, Ps etc)

  • You may NOT sublicense, rent, lent, assign, gift, transfer, distribute, or grant rights to DIGITAL DESIGN in ANY way

  • You can NOT REDISTRIBUTE/SHARE/EXCHANGE or SELL IN A DIGITAL PRODUCTS BUNDLE.

  • You can NOT REDISTRIBUTE/SHARE/EXCHANGE for FREE or as a GIFT

4.2 Commercial license

  • Commercial License allows you to create end products for sale UNLIMITEDLY. You have right to use and modify the design from the site once purchased. BUT you do not have the right to resale the files.

5. Return & refund policies

Due to the nature of DIGITALS PRODUCTS, all sales are final. DIGITAL ITEMS ARE NON-REFUNDABLE & NON-EXCHANGEABLE.  If you experience issues with downloading or accessing your purchase, please contact us at vy.designs@outlook.com for assistance.

6. Payment
PAYPAL ONLY
When paying by PayPal, Vy Phan reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. VSVB reserves the right to deny any purchase. The currency used is US DOLLAR (USD) for all countries.
